BODY+BEYOND LTD – TERMS & CONDITIONS

BILLING POLICY

I understand and agree that I will be charged using my saved credit/debit card for my membership/package. If I have signed up for a monthly membership this will auto renew each month. The membership/package entitles me to attend a set number of sessions per month in line with the membership/package I have purchased.

I acknowledge and agree that this membership/package is not transferable or assignable. I acknowledge that payment is required for the membership/package in advance of actual training sessions.

I understand that I will be charged for missed or unused session(s). No refund will be granted for sessions that have not been completed.

I understand Body+Beyond Ltd. has the right and the authority to terminate the programme at any time, with no refund, if I do not follow the programme or fail to conduct myself appropriately.

All sessions within the membership/package must be undertaken within 30 days of the billing date for monthly memberships and within 2 or 6 weeks of your first session for a 2 or 6-week kickstart package. Any remaining sessions will become void after this period and cannot be transferred, brought forward as credit or taken at a later date.

I can request to extend the use of missed sessions but this is at the discretion of Body+Beyond Ltd.

MEMBERSHIP CANCELLATION POLICY

I understand that I may cancel my package in the first 30 days during my ‘trial’ period at any point.

For monthly memberships, I understand and agree that this agreement is a month-to-month agreement “monthly membership”. Except as otherwise noted, this agreement will remain active unless I cancel it by giving exactly 60 days written/email notice to Body+Beyond Ltd. any scheduled billings during these 60 days will be processed as usual and my membership will be terminated at the end of the last billing period.

I understand that Body+Beyond Ltd. reserves the right to cancel my membership/package at any time.

 

​​MEMBERSHIP/PACKAGE FREEZE / PAUSE POLICY

I understand and agree that I can only request to pause/freeze my membership under extenuating circumstances such as injuries or illnesses that prevent me from attending sessions and I understand this is at the discretion of Body+Beyond Ltd when suitable evidence is provided from my doctor.

I understand that Body+Beyond Ltd does not offer freezes or pauses of memberships in any other circumstances like personal or professional travel.

During my freeze/pause, I understand my membership payment will not be suspended for the duration of the date range requested instead I will receive credit for the duration of the date range requested which will be deducted from my next payment when I return. 

Membership freeze requests must be sent via email to freeze@bodybeyond.co.uk, we do not retroactively freeze and freezes are not allowed in the first month of the membership.

Cancellation of Membership cannot be requested within 30 days of a freeze request and membership cannot be requested to cancel at the end of a freeze period.

In the case of emergencies, injuries or illnesses when the 24-hour cancellation notice period is met, we can accept freeze requests 

 

LATE CANCELLATION OF SESSIONS POLICY

I acknowledge that session/appointment times are reserved and that cancellations must be made a minimum of 12 hours in advance before the start of the scheduled training session time by calling or emailing your trainer/coach. Cancelled sessions with a 12-hour notice can be used later within a month of the cancellation being made providing there is availability, if the cancelled session(s) are not used within the same month they will count as a missed session and a refund will not be issued.

I understand that I will not receive a refund for missed sessions or appointments, therefore it is my responsibility to attend my training sessions/appointments when they are scheduled. If a cancellation is not made by a minimum of 12 hours before the scheduled session, I understand that I will be charged for the session. Likewise, a ‘no show’ counts as a session serviced and I will be charged. I understand that appointments will begin and end promptly as scheduled. I acknowledge that any delays to the start of a scheduled appointment will not be a valid cause to extend the provided service beyond the remainder of the scheduled time. I will not expect or ask my trainer/coach to run overtime. I understand that if I am more than 15 minutes late, my session will be cancelled, and I will be charged for that session. I acknowledge that a delay to a scheduled session cannot change the session status to anything else except a whole session. I understand that there are no half-sessions as a result of any delay.

 

RELEASE OF LIABILITY 

I recognise my trainer/coach is not able to provide me with medical advice about existing conditions and acknowledge that I should consult my GP to confirm my suitability to exercise.

By purchasing a membership/package or booking a session I have enrolled in a programme of strenuous physical activity including, but not limited to, walking, running, boxing, dance, kickboxing, weight lifting, step aerobics, aerobics, body sculpting and the use of various conditioning and exercise equipment and facilities designed, offered, recommended, and/or supervised by my trainer.

I hereby affirm that I am in good physical condition and do not suffer from any disability that would prevent or limit my participation in this programme.

I fully understand that I may suffer injury as a result of my participation in the programme and I hereby release my trainer and Body+Beyond Ltd. from any liability now or in the future, including but not limited to, medical expenses, lost wages, pain and suffering, that may occur because of heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, and any other illness, soreness, or injury, however, caused, whether occurring during or after my participation in the programme or use of the conditioning and exercise equipment and facilities, regardless of fault.

In consideration of my participation in the programme, I for myself, my employees, heirs, assigns, agents, officers, directors, shareholders and co-workers hereby release Body+Beyond Ltd., the personal trainer/coach, their employees, spouse, relatives, heirs, assigns, agents, officers, directors, and shareholders, from any claims, demands or causes of action arising from my participation in the programme or from any use of the conditioning and exercise equipment and facilities.

 

CONDUCT OF TRAINING SESSIONS

 I must wear proper attire (i.e. shorts, sweat pants, t-shirt, trainers/running shoes, etc.) No jeans, jean shorts, sandals, or open-toe shoes of any kind may be worn. All sessions will be conducted at a location as agreed upon by both the personal trainer/coach & me the client. Training sessions will usually last 50 minutes in duration.

 

I understand this contract and the terms it presents are for the purchase of any membership/package/session and any other purchase of services in the future. I acknowledge that this specific contract, the release of liability, consent, and agreement is continuously valid indefinitely.

I understand that Body+Beyond Ltd reserves the right to amend these terms and conditions at any time.

I hereby state that I have read, understood and agree to the terms and conditions and by proceeding, I attest, contract, acknowledge, and agree that I am legally bound by its contents.
